Terms of Service
Effective date: October 19, 2026
These Terms of Service ("Terms") govern your use of CRM (the "Service"), a customer relationship management software for real estate professionals provided by Michael Gebhard, PA ("we", "us"). By creating an account, accepting an invitation or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("you").
1. Your Account
- You must be at least 18 and, if you use the Service for real estate activity, properly licensed where you operate.
- The account owner is responsible for everyone they invite (teammates) and for all activity in the account.
- Keep your login secure; tell us right away about any unauthorized use. Two-factor authentication is available and recommended.
2. Subscription, Trial and Payment
- Paid plans renew monthly until cancelled. A free trial (if offered) converts into a paid subscription at its end unless you cancel before then. Prices are shown before you subscribe.
- Payments are processed by Stripe. You authorize recurring charges to your payment method.
- You can cancel any time in Settings → Billing; the subscription ends at the end of the paid period. Fees already paid are not refunded, except where required by law.
- If a payment fails, we notify you. If it remains unpaid for seven days, the account is paused (nothing is deleted) and reactivates once the payment succeeds.
- Plans include usage limits (for example a monthly number of emails), shown in Settings → Billing.
- Accounts we set up for you under a separate agreement ("managed") follow that agreement for fees.
3. Your Responsibilities for Outreach and Compliance
The Service gives you tools to contact people. You decide whom you contact and how, and you are responsible for complying with all laws that apply to your outreach, including:
- Calls and texts: the Telephone Consumer Protection Act (TCPA), the Florida Telephone Solicitation Act and Do-Not-Call rules — including obtaining and keeping proof of prior express written consent for automated or AI-voice calls and texts, honoring opt-outs, and calling only within permitted hours.
- Email: the CAN-SPAM Act, including a valid physical address, honest sender and subject information and a working unsubscribe.
- Real estate advertising: including Florida's requirement to show your licensed brokerage name, and the Fair Housing Act — you must not use the Service to discriminate or to steer, blockbust or redline.
- AI assistant and recordings: the AI voice assistant identifies itself as an AI; you are responsible for any additional disclosure and for consent to call recording where required (Florida requires the consent of all parties).
- Your own providers: phone service (Twilio), AI voice (ElevenLabs), advertising (Meta) and calendar (Google) are connected with your own accounts and governed by their terms. You are responsible for their fees and for registrations they require, such as SMS registration (A2P 10DLC).
The Service includes safeguards (for example consent checks, calling-hour limits and required brokerage names), but they do not replace your own compliance or legal advice.
4. Acceptable Use
You will not use the Service to:
- send spam or contact people without the consent the law requires, or use purchased or scraped contact lists for automated outreach;
- upload unlawful, deceptive, infringing or harmful content, or impersonate anyone;
- interfere with the Service, probe its security, or access other accounts;
- resell the Service without our written agreement.
We may suspend accounts that violate these rules or put others at risk, and will tell you why where we can.
5. Your Data
- You own the data you put into the Service ("Customer Data"), such as contacts, messages and pages. We process it only to provide the Service, as described in our Data Processing Agreement.
- You confirm you have the right to upload Customer Data and to contact the people in it as you do through the Service.
- After cancellation you can request an export within 30 days; afterwards we may delete Customer Data, subject to backups that expire on their normal schedule.
6. AI Features
AI features (such as the voice assistant) can make mistakes. Review their settings and results, and do not rely on them for legal, financial or other professional advice. You are responsible for how you use their output.
7. Availability and Changes
We work to keep the Service available and secure but do not guarantee uninterrupted operation. We may improve or change features; if we remove a major feature you pay for, we will tell you in advance.
8. Disclaimer and Limitation of Liability
The Service is provided "as is". To the extent permitted by law, we disclaim implied warranties, and our total liability for any claim relating to the Service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect, incidental or consequential damages, lost profits or lost data, or for fines or claims resulting from your outreach.
9. Indemnity
You will defend and indemnify us against claims, fines and costs arising from your Customer Data, your outreach (including calls, texts and emails sent through the Service) or your breach of these Terms.
10. Termination
You can stop using the Service and cancel any time. We may terminate or suspend accounts for material breach, non-payment or legal reasons. Sections 3, 5, 8, 9 and 11 survive termination.
11. Law and Disputes
These Terms are governed by the laws of the State of Florida. Courts in Miami-Dade County, Florida have exclusive jurisdiction, unless the law requires otherwise.
12. Changes to These Terms
We may update these Terms. For material changes we will notify you in the Service, and you will be asked to accept the new version before continuing to use it.
